Terms of Service

FlirtAlly is operated by AIQ Labs Limited, DBA Flirtally.com ("FlirtAlly", "we", "us"), Box 436, Hantsport, Nova Scotia, Canada B0P 1P0. FlirtAlly provides AI-generated companion characters ("Companions") that converse via text, voice, and generated media. All Companions, messages, images, videos, and voices are entirely artificial — no human is speaking with you. See our AI Disclosure for details.

You must be 18 or older to use FlirtAlly. By using the service you represent that you are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher). Access to adult-rated content additionally requires third-party age verification and a plan that includes adult content access. We may suspend accounts we reasonably believe belong to minors.

You are responsible for activity under your account and for keeping your credentials confidential. Guest (anonymous) usage is tied to your device/browser and may be linked to a registered account you create. Providing false age, identity, or verification information is grounds for termination.

The following are prohibited with zero tolerance — no warnings, no second chances. Accounts are suspended immediately and reported to authorities where legally required.

• Minors in any form — including roleplay, age-play, “pretending”, school-age framing, or any content depicting or suggesting a person under 18, real or fictional
• Animals — sexual content involving animals, or companion characters that are or resemble animals
• Incest — romantic or sexual content between family members, including step-relations
• Non-consent — forced, coerced, or unconscious/unwilling scenarios in any framing
• Real people — celebrities, public figures, influencers, lookalikes, deepfakes, or anyone who has not consented
• Graphic violence — gore, torture, snuff, or sexualized harm

Requests in these categories are automatically blocked and logged before any content is generated. Attempting them — including via uploads, voice, email, or creative phrasing — is itself the violation. Every signup affirmatively accepts this policy.

You agree not to:

• Use the service if you are under 18, or attempt to generate content depicting minors in any context
• Request, generate, or distribute content that is illegal, non-consensual, defamatory, or depicts real identifiable people without their consent
• Circumvent age verification, content ratings, usage limits, or safety systems
• Use outputs to harass, deceive, or harm others, or to imply a real person's endorsement
• Reverse-engineer, scrape, or resell the service or its generated content at scale
• Interfere with the platform's operation or other members' use

We may refuse to generate, remove, or report content and suspend accounts that violate these rules.

FlirtAlly operates tiered content ratings. Adult ("spicy") content is available only to members who have (a) completed third-party age verification, (b) enabled the adult content rating in their consent settings, and (c) subscribed to an eligible plan. Attempting to bypass these controls — including by crafting prompts or scene descriptions designed to elicit adult content on a non-adult account — is a violation of these Terms.

Certain features consume credits. Credits are a limited-license in-app currency: they have no cash value, are non-transferable, and are generally non-refundable except where required by law or where we explicitly state otherwise. Subscriptions renew automatically until cancelled and may include recurring credit grants. Charges appear on your payment statement under the billing descriptor shown to you at checkout; if a charge ever appears that you don't recognize, contact us before disputing — see the Refund Policy for how quickly we resolve this. Prices, plan limits, and credit costs may change prospectively with notice. Chargebacks or payment disputes may result in credit reversal and account suspension. Marketing emails are optional: every marketing email carries a one-click unsubscribe link, and you can withdraw marketing consent at any time without affecting your account.

Approved creators may publish Companions and earn a share of qualifying member spend attributable to those Companions. Creator terms, payout eligibility, hold periods, and revenue-share rates are posted in the creator portal and may be updated by FlirtAlly. Creators are independent contractors; we may withhold payouts pending investigation of fraud or Terms violations.

Companion messages and media are generated by artificial intelligence and may be inaccurate, inconsistent, or unexpected. Companions are not therapists, counselors, or medical providers, and nothing in the service constitutes professional advice. If you are in crisis, contact your local emergency services or a crisis line (see the AI Disclosure for resources).

You retain rights to photos, text, and other content you submit. You grant FlirtAlly a non-exclusive license to process, store, and transmit that content as needed to operate the service (for example, using your photo to compose "us together" images you request). You represent that you own or have permission to submit everything you upload, and that it does not depict anyone who has not consented.

We use automated classifiers and human review to enforce these Terms. You can report any Companion message in the app; reports enter a review queue and may result in content changes, feature restrictions, or account action. We may preserve and disclose data where required by law or to protect safety.

You may delete your account at any time from the privacy/consent center. We may suspend or terminate accounts for violations, fraud, safety risks, or non-payment. On deletion we remove personal data as described in the Privacy Policy, subject to legal retention requirements.

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, FlirtAlly is not liable for indirect, incidental, consequential, or emotional-distress damages arising from use of the service, and our aggregate liability is capped at the greater of the amounts you paid us in the prior 12 months or CAD $100.

Some companion games let you stake simulated credits on the outcome. Credits are entertainment tokens with no cash value, cannot be cashed out, transferred, or exchanged for anything of value, and game outcomes have no real-money consequence whatsoever. This is simulated wagering for roleplay only — it is not gambling, no real currency can be won or lost, and daily win caps apply. Purchasing credits to stake on games does not entitle you to any payout.

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of Nova Scotia, unless consumer-protection law in your jurisdiction gives you a non-waivable right to bring claims locally.

We may update these Terms; material changes will be announced in-app or by email (if we have an address on file). Continued use after the effective date constitutes acceptance.
